Terms of Service

1. Acceptance of These Terms
These Terms of Service ("Terms") are a contract between you and [Your Legal LLC Name] LLC, a [New York] limited liability company operating as "Thirty Straight" ("Thirty Straight," "we," "us"). They govern your use of thirtystraight.com (the "Site") and the Thirty Straight membership (the "Service").
By using the Site or starting a membership, you agree to these Terms and to our Privacy Policy and Membership Agreement. If you don't agree, don't use the Service. If you and these Terms and the Membership Agreement ever conflict about your membership specifically, the Membership Agreement wins.
2. Who Can Join
You must be at least 18 years old and legally able to enter a contract to use the Service. The Service is not for minors.
Thirty Straight is a coaching service built for men. The advice, format, and examples are designed with men roughly 25–50 in mind. That's an honest description of who the Service is for, not a legal restriction we enforce at the door.

3. What the Service Is — and What It Is Not
Thirty Straight is personal coaching and mentorship. Depending on your plan, membership includes:
- Two 30-minute one-on-one video sessions per month with James. Sessions are per monthly billing period and do not roll over — unused sessions expire at the end of the billing period.
- A direct WhatsApp line to James. James replies within a few hours, 9am–9pm ET, 7 days a week. Replies are not instant and the line is not monitored around the clock.
The Service covers practical topics: career, money, dating, discipline, and decisions. It offers advice, strategy, and accountability. What you do with that advice is your call, and the outcomes of your decisions are your responsibility.
Coaching scope. Thirty Straight is not therapy, counseling, psychotherapy, or medical or mental-health care, and James is not a licensed therapist, physician, psychologist, or medical provider of any kind. James does not diagnose or treat any condition. Nothing in the Service is licensed professional care — medical, legal, financial, tax, or otherwise. If you need a licensed professional, hire one; the Service is not a substitute for one. Your conversations with James are private under our Privacy Policy, but they are not protected by any professional–client privilege (such as doctor–patient or attorney–client privilege), and no such relationship is created.
"James" is a professional name used by the individual coach who operates the Service.
4. Not for Crises
The Service is not a crisis service and must never be used as one. The direct line is answered within a few hours during the stated window — it is not an emergency channel.
If you're in crisis, or thinking about harming yourself or someone else, call or text 988 (Suicide & Crisis Lifeline — free, confidential, 24/7) or call 911 right away. Do not wait for a reply on the direct line.
5. Member Conduct
Keep it straight. As a member, you agree not to:
- Record, share, or publish sessions or direct-line messages without written permission from us;
- Harass, threaten, or abuse James or anyone else connected to the Service;
- Share your membership, login, or direct-line access with anyone else;
- Use the Service for anything unlawful, or to seek help with unlawful activity;
- Misrepresent who you are during signup or intake.
We may suspend or end a membership that violates these Terms. If we end your membership for a reason other than your breach, we'll refund the unused portion of your current month.
6. Membership, Billing, and Cancellation
Plans and prices. Current plans are:
- Founding Thirty — $149/month. Limited to the first 12 members. Your founding price never increases for as long as you remain continuously subscribed. If your membership lapses and you rejoin later, the then-current price applies.
- The Thirty — $299/month.
Automatic renewal. Membership is month-to-month. It renews automatically each month, and your payment method is charged the plan price each billing cycle, until you cancel. Before you pay the first time, checkout shows you the price, the renewal frequency, and how to cancel, and asks for your affirmative consent — no pre-checked boxes.
Confirmation. After signup, we send a confirmation email that restates your price, the renewal terms, and how to cancel, so you have them in writing.
Cancellation. You can cancel anytime, online, in one step, from your member account (the Stripe customer portal). No phone call, no email required, no hoops. Cancellation takes effect at the end of your current billing period; you keep access until then. We do not give partial-month refunds unless the law requires it.
Sessions. Sessions are allotted per month and do not roll over. Missed sessions without reasonable notice count as used; we'll be fair about genuine emergencies.
Changes to price or terms. If we change your price or any material term of your membership, we'll email you clear notice at least 5 days and no more than 30 days before the change takes effect. Founding Thirty members are exempt from price increases while continuously subscribed. If you don't accept a change, cancel before it takes effect and you won't be charged the new terms.

7. Intellectual Property
We own the Site, the Thirty Straight name and marks, and all materials we create — including frameworks, worksheets, session structures, and anything James sends you as part of the Service. You get a limited, personal, non-transferable license to use those materials for your own life while you're a member. You may not resell, republish, or teach from them.
You own your own information and anything you share with us. If you send us feedback or suggestions, we can use them without owing you anything.
8. Disclaimers of Warranties
The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not promise outcomes. Advice is input; results depend on your situation, your effort, and factors nobody controls. For clarity, and as stated above: the Service is not therapy, counseling, or medical or mental-health care, and no warranty should be read as implying otherwise.
9. Limitation of Liability
To the fullest extent the law allows: (a) neither Thirty Straight nor James is liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost opportunities, arising out of the Service; and (b) our total liability for any claim arising out of the Service is capped at the amounts you paid us in the 12 months before the claim arose.
Some jurisdictions don't allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

10. Indemnification
You agree to indemnify and hold harmless Thirty Straight and James from claims, damages, and reasonable legal costs arising from your breach of these Terms, your misuse of the Service, or your violation of any law or third-party right — except to the extent caused by our own breach or misconduct.
11. Dispute Resolution

Until the placeholder above is resolved, the parties' disputes are governed by Section 13 (Governing Law).
12. Changes to These Terms
We may update these Terms. If a change is material to your membership — price, what's included, renewal, or cancellation — we'll email you at least 5 days and no more than 30 days before it takes effect, and you can cancel before then if you don't agree. Non-material changes (like clarifications or typo fixes) take effect when posted, with the date above updated. Continued use of the Service after a change takes effect means you accept it.
13. Governing Law
These Terms are governed by the laws of the State of New York, without regard to its conflict-of-laws rules. Subject to Section 11 once finalized, any dispute will be brought in the state or federal courts located in New York County, New York, and both parties consent to that venue.

14. General
If any part of these Terms is unenforceable, the rest still stands. Our not enforcing a provision isn't a waiver of it. You may not assign these Terms; we may assign them in connection with a sale or reorganization of the business. These Terms, together with the Privacy Policy and Membership Agreement, are the entire agreement between us about the Service.
